Insurance and Litigation

Insurance issues are a major preoccupation for those whose homes have been destroyed or damaged by smoke. Some Palisadians had their insurance canceled in the months before the fire, the limitations of the FAIR plan have become apparent, insurance companies have switched adjusters for claimants multiple times, non-communicative adjusters make matters difficult, itemization is a protracted ongoing stressor for many, and there are numerous reports of lowballing. Public adjusters offer their services, but many people are just grinding through it.

The California Department of Insurance, headed by Commissioner Ricardo Lara has been active. On Feb. 6, Commissioner Ricardo Lara issued a notice calling on insurance companies to provide "up to 100% of Contents (Personal Property) coverage limits without requiring the policyholder to undertake the onerous task of completing a detailed personal property inventory." Some companies responded favorably while others showed a disappointing lack of concern.

Many attorneys, ready to litigate against companies acting in bad faith or those who may have caused the fires, are seeking clients.
